TERMS AND CONDITIONS Effective Date: 05/30/2026 These Terms and Conditions ("Terms") govern your use of the websites, online stores, marketplaces, products, and services operated by Hasco Harris Enterprises LLC and its subsidiaries, affiliates, divisions, and brands, including but not limited to HascoDirect, Big Deal Liquidators, D5 Home Brands, Nevaeh Pure, and any successor or affiliated entities (collectively referred to as "Company," "we," "our," or "us"). By accessing our websites, purchasing products, creating an account, or using our services, you agree to be bound by these
Terms. 1. PURCHASE AGREEMENT AND SALES TERMS Order Acceptance All orders submitted to the Company are offers to purchase products and are subject to acceptance by the Company. An order confirmation email acknowledges receipt of your order but does not constitute acceptance of the order. We reserve the right, in our sole discretion, to refuse, reject, cancel, limit quantities, or terminate any order for reasons including but not limited to: • Product unavailability • Inventory shortages • Pricing or typographical errors • Suspected fraud • Payment authorization issues • Violation of these Terms • Marketplace restrictions If your order is canceled after payment has been processed, a refund will be issued to the original payment method. Pricing All prices are listed in U.S. Dollars unless otherwise specified. We reserve the right to modify pricing at any time without notice. Pricing errors may occur. We reserve the right to cancel orders resulting from obvious pricing mistakes, system errors, or incorrect product descriptions. Payment Terms Accepted payment methods may include: • Major credit cards • Debit cards • PayPal • Apple Pay • Google Pay • Amazon Pay • Shop Pay • Other approved payment providers Payment must be received and authorized before shipment. Customers are responsible for all applicable: • Sales taxes • Use taxes • Import duties • Customs fees • Governmental assessments
2. SHIPPING AND DELIVERY Shipping Services Orders are shipped through third-party carriers, including but not limited to: • USPS • UPS • FedEx • DHL • Amazon Logistics • Other authorized carriers Delivery Timeframes Delivery estimates are provided for convenience only and are not guaranteed. Actual delivery times may vary due to: • Weather conditions • Carrier delays • Supply chain disruptions • Customs inspections • Force majeure events The Company shall not be liable for delays caused by shipping carriers or circumstances beyond our reasonable control. Geographic Restrictions We reserve the right to limit or refuse shipments to certain states, territories, countries, military addresses, freight forwarders, or other destinations. Lost or Delayed Shipments Customers must notify the Company within ten (10) business days of a confirmed delivery issue. We will cooperate with the carrier to investigate lost shipments; however, we do not guarantee replacement or reimbursement until the carrier's investigation is complete. Risk of Loss Title and risk of loss transfer to the customer upon delivery of the products to the carrier for shipment. Once a package has been accepted by the carrier, the Company is not responsible for loss, theft, delay, damage, or misdelivery caused by the carrier.
3. RETURNS AND REFUNDS Return Eligibility Unless otherwise stated in product-specific policies, eligible products may be returned within thirty (30) days of delivery. Returned products must: • Be unused • Be in original condition • Include original packaging • Include all accessories and documentation • Be free from damage caused by the customer The Company reserves the right to deny returns that do not meet these requirements. Non-Returnable Items The following items may not be returned: • Clearance items • Final sale items • Customized products • Personalized products • Opened consumable products • Hygiene-related products • Gift cards • Digital products Return Shipping Costs Unless the return results from our error, defective merchandise, or incorrect shipment, customers are responsible for return shipping costs. We recommend using trackable shipping services. Restocking Fees Approved returns may be subject to a restocking fee of up to fifteen percent (15%) of the purchase price where permitted by law. Refund Processing Approved refunds will be issued to the original payment method. Refund processing may require: • Receipt of returned merchandise • Product inspection • Verification of return eligibility Refunds are typically processed within ten (10) business days after approval. Original shipping charges are generally non-refundable.
4. PRODUCT WARRANTIES Except where expressly provided by the manufacturer, products are sold "AS IS" and "AS AVAILABLE." The Company disclaims all warranties, whether express or implied, including: • Merchantability • Fitness for a particular purpose • Non-infringement • Performance expectations Any manufacturer warranty remains solely the responsibility of the manufacturer.
5. USER ACCOUNTS Users may be required to create accounts to access certain services. You are responsible for: • Maintaining account confidentiality • Restricting unauthorized access • Protecting passwords • All activity occurring under your account We reserve the right to suspend or terminate accounts for: • Fraudulent activity • Chargebacks • Abuse of return policies • Violation of these Terms • Illegal conduct • Marketplace manipulation
6. INTELLECTUAL PROPERTY All content owned or controlled by the Company is protected by applicable intellectual property laws. This includes but is not limited to: • Trademarks • Trade names • Logos • Product images • Videos • Graphics • Website content • Marketing materials • Product descriptions • Software and code No content may be copied, reproduced, distributed, modified, or used without prior written consent from the Company. Unauthorized use may result in legal action.
7. PROHIBITED ACTIVITIES Users may not: • Engage in fraudulent transactions • Reverse engineer Company systems • Interfere with website operations • Upload malicious software • Misrepresent identity • Violate applicable laws • Infringe intellectual property rights The Company reserves the right to investigate and pursue remedies for violations.
8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY: • INDIRECT DAMAGES • INCIDENTAL DAMAGES • CONSEQUENTIAL DAMAGES • SPECIAL DAMAGES • PUNITIVE DAMAGES • LOSS OF PROFITS • LOSS OF REVENUE • LOSS OF DATA • BUSINESS INTERRUPTION ARISING FROM: • PRODUCT USE • PRODUCT MISUSE • WEBSITE ACCESS • WEBSITE UNAVAILABILITY • DELIVERY DELAYS • THIRD-PARTY ACTIONS IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT GIVING RISE TO THE CLAIM.
9. INDEMNIFICATION You agree to defend, indemnify, and hold harmless the Company and its affiliates from any claims, liabilities, damages, losses, costs, or expenses arising from: • Your use of Company services • Violation of these Terms • Violation of applicable law • Infringement of third-party rights
10. PRIVACY Use of our websites and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. FORCE MAJEURE The Company shall not be liable for any failure or delay resulting from events beyond its reasonable control, including: • Natural disasters • Floods • Fires • Pandemics • Labor disputes • Government actions • Transportation disruptions • Cyberattacks • Utility interruptions
12. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to conflict-of-law principles. Any federal claims shall be governed by applicable federal law.
13. DISPUTE RESOLUTION Mandatory Good Faith Resolution Before initiating formal legal action, both parties agree to attempt to resolve disputes through good-faith negotiations. Binding Arbitration Except for matters eligible for small claims court, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). The arbitration shall take place in Burlington County, New Jersey, unless otherwise agreed by the parties. The arbitrator's decision shall be final and binding. Small Claims Exception Either party may pursue claims within the jurisdictional limits of a New Jersey Small Claims Court. Class Action Waiver To the fullest extent permitted by law, disputes shall be brought only in an individual capacity. Customers waive any right to participate in class actions, consolidated actions, or representative proceedings.
14. SEVERABILITY If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT These Terms constitute the entire agreement between the customer and the Company regarding purchases, products, services, and website use.
16. CHANGES TO TERMS The Company reserves the right to modify these Terms at any time. Updated Terms become effective immediately upon posting. Continued use of our websites, services, or products constitutes acceptance of any revised Terms.
